The following Terms of Service ("Terms") apply to all digital powers of attorney and services offered by e-fuldmagt via the platform, which includes both the mobile application and the web application (collectively referred to as the "Platform"). These Terms apply to all users who create a profile and/or use the Platform. All users are encouraged to read these Terms thoroughly before creating a profile and using the Platform.
1.1 To create and use digital powers of attorney, users must register a profile on the Platform. Access to the Platform’s services requires profile registration.
1.2 e-fuldmagt reserves the right to deny new user registrations or to remove existing users from the Platform at its discretion. This may occur in cases of suspicious behavior, offensive communication directed at e-fuldmagt staff, or other actions that may harm the Platform's users or operations.
1.3 Users may request the deletion of their profile and associated data on the Platform. Certain data may, however, be retained due to statutory requirements, such as those under bookkeeping or anti-money laundering regulations, and will therefore not be immediately deletable. Such information will be stored for up to 5 years, after which it will be permanently deleted.
1.4 e-fuldmagt strives to maintain stable operation and accessibility of the Platform. However, temporary interruptions may occur due to circumstances beyond e-fuldmagt's control, and e-fuldmagt cannot be held liable for interruptions or limited access to the Platform under such conditions.
2.1 Prices for powers of attorney are clearly stated on the Platform and are provided in Danish Kroner (DKK). The Platform uses an SSL certificate to secure data, and all payment information is handled via SSL-secured connections.
2.2 Payment methods:
- Mobile App (iOS/Android): Payments are processed via in-app purchases on the Apple App Store or Google Play.
- Web App: Payments made on the website can be made using Visa, Mastercard, Dankort, or MobilePay, and are processed through Quickpay.
2.3 Users have a 14-day right of withdrawal for purchases made via the Platform. Refund requests can be made by contacting our support team at support@e-fuldmagt.dk.
3.1 The purchased digital powers of attorney are typically available in the user's profile immediately after payment is completed. These documents can be accessed and used via the user’s profile.
3.2 Certain services may require registration with public authorities, such as the Danish Business Authority or the Land Registry. e-fuldmagt cannot guarantee delivery times for services that require approval by public authorities, as this depends on the receipt of correct information and necessary documentation from the user, as well as the approval by the relevant authority. e-fuldmagt cannot be held liable for delays in these cases.
3.3 If the user starts creating a power of attorney or other service but does not complete the payment, the user may save it as a draft. This draft will automatically be deleted after a predetermined number of days, depending on the type of service. The user will receive a reminder email before deletion, allowing them to review the draft.
4.1 Users have full rights to return products and services purchased on the Platform, regardless of whether they are customized for the individual user.
4.2 However, the right of withdrawal lapses if the purchase includes a product or service that requires registration with a public authority, such as the Danish Business Authority or the Land Registry. If e-fuldmagt has completed such a registration and delivered the service, or incurred costs in connection with the registration, the right of withdrawal no longer applies. This also applies if the registration cannot be completed due to the user’s circumstances, and e-fuldmagt has already invested significant time in the task.
4.3 If a user wishes to cancel a purchase made on the Platform and if the right of withdrawal has not lapsed, the user must contact e-fuldmagt's support. The user will then receive confirmation by email with either approval of the refund or a reason for any denial in accordance with point 4.2. Refunds are transferred to the same payment method originally used. Processing of refunds typically takes 5-10 business days from receipt of the request.
5.1 e-fuldmagt does not provide legal advice. Neither the Platform’s general information, written correspondence, nor any other contact with e-fuldmagt can be considered specific legal advice.
5.2 e-fuldmagt is responsible for the content of the products and services that can be created through the Platform. Should there be any errors in the content of a digital power of attorney that result in financial loss for the user, or if an incorrect registration with a public authority leads to financial loss, claims may be made against e-fuldmagt. The user can submit a complaint by contacting support@e-fuldmagt.dk.
To process the complaint effectively, e-fuldmagt may request the following documentation:
- Description of the error: A detailed explanation of the error in the digital power of attorney, including its impact on the user.
- Documentation of financial loss: Proof of financial loss, including, for example, invoices, receipts, or other payment evidence related to the loss.
- Copy of the relevant power of attorney: A copy of the specific power of attorney in question to verify and investigate the error's origin and scope.
- Timeline of events: A chronological overview of events, if the error has developed over time and has affected the user’s situation.
5.3 e-fuldmagt accepts no liability for the incorrect use of products or services on the Platform. This includes incorrect usage in general or incorrect information entered by the user when creating a power of attorney.
5.4 e-fuldmagt is liable only for direct financial losses. Users cannot make claims for indirect losses such as lost profits, revenue losses, goodwill, or similar consequential damages that indirectly result from an incident.
5.5 e-fuldmagt is not responsible for temporary disruptions on the Platform, system damage, computer viruses, hacking, misuse of personal data, or other unforeseen events beyond e-fuldmagt's control. e-fuldmagt employs regular security updates and system monitoring to protect user data from hacking and virus attacks.
6.1 Personal data is processed in accordance with applicable data protection regulations. The Privacy Policy is accessible from the Platform’s homepage.
7.1 In the first instance, the parties will attempt to resolve any disputes arising in connection with these Terms through amicable dialogue and negotiation.
7.2 If it is not possible to reach an amicable solution and the parties cannot agree, the dispute shall be brought before the District Court of Odense as the venue.
